Terms of Use
1. Agreement to These Terms
These Terms of Use (the “Terms”) govern your access to and use of the websites, mobile applications, and services operated by Workscaler Inc., doing business as Resumás (“Resumás,” “Workscaler,” “we,” “us,” or “our”). The services include resume creation and optimization, AI-assisted career tools, job-search tools, career guidance, coaching, content, subscriptions, and related features (collectively, the “Services”).
By creating an account, purchasing a subscription, downloading an app, or otherwise accessing or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.
If you use the Services for an organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you are under the age of 18, use the Services only with the permission and supervision of a parent or legal guardian. The Services are not directed to children under 16.
2. Accounts and Access
You must provide accurate, current, and complete information when creating and maintaining an account. You are responsible for safeguarding your login credentials and for activity occurring through your account. Notify us promptly at support@resumas.com if you suspect unauthorized account access.
You may not sell, transfer, share, rent, or allow another person to use your account without our written permission. We may require identity verification before providing account support, responding to certain requests, or restoring account access.
Where the Services offer meaningful functionality without an account, you may use that functionality without registering. Features that require saving career materials, syncing information, subscriptions, or personalized tools may require an account.
3. Resumás Services
Resumás provides tools intended to support job seekers and career development, including resume building and tailoring, keyword and job-match analysis, career-content generation, job-search organization, job alerts, application tracking, interview preparation, professional-profile support, Ghost Job Detector results, Do Not Apply Guidance, and related tools. Features, availability, and eligibility may vary by plan, location, device, platform, and time.
Some Services may use automation, algorithms, machine learning, or generative artificial intelligence (“AI”). AI outputs may include draft text, recommendations, scores, classifications, or other suggestions based on information you submit. Your use of AI features is also subject to the AI provisions in Section 6 and the Privacy Policy.
4. Career Tools Are Not Guarantees
The Services are informational and educational tools. They are not employment-agency, recruiting, staffing, legal, tax, financial, medical, mental-health, immigration, or other regulated professional services.
Resumás does not guarantee an interview, job offer, placement, promotion, salary result, employer response, job availability, accuracy of a job posting, or any other employment outcome. Job-match scores, ATS-related assessments, Ghost Job Detector results, Do Not Apply Guidance, and other recommendations are decision-support information only. They do not establish that a job is genuine or fraudulent, that you should or should not apply, or that an employer will take any action.
You are responsible for reviewing all resumes, applications, career materials, employer communications, and AI outputs for accuracy, legality, completeness, tone, and suitability before using or sharing them. Do not represent AI-generated content as a fact if you have not verified it. You remain responsible for your job-search and career decisions.
5. Human Coaching
If included with your plan, coaching or guidance is general career support based on the information you choose to provide. It is not individualized legal, tax, financial, immigration, medical, mental-health, or licensed professional advice. Coaches do not guarantee an employment outcome, and you remain responsible for your decisions and materials.
Appointments, cancellations, rescheduling, attendance, refunds, and other coaching-specific terms may be described at checkout, in your plan details, or in a separate written agreement. If a separate agreement conflicts with these Terms for a coaching engagement, that agreement controls for that engagement.
6. AI Features
6.1 Permitted Use
You may use AI features only for lawful, personal, and professional career-support purposes. You must not submit information you do not have the right to use, including another person’s confidential, private, copyrighted, or personal information without authorization.
6.2 Review of Outputs
AI may generate inaccurate, incomplete, biased, outdated, or unsuitable output. You must independently review and edit all output before relying on it or submitting it to an employer, recruiter, school, government agency, professional network, or other third party.
6.3 Prohibited AI Use
You must not use the Services or AI outputs to:
- Create false credentials, fabricated employment history, altered qualifications, fake references, forged documents, or other deceptive job-search materials.
- Impersonate another person, misrepresent your identity, qualifications, authorization, or experience, or deceive an employer or recruiter.
- Generate unlawful, discriminatory, harassing, defamatory, invasive, fraudulent, malicious, or infringing content.
- Upload or submit passwords, payment-card data, Social Security numbers, government identifiers, health records, or other sensitive data that is not necessary for the requested feature.
- Use the Services to develop competing products, evade safeguards, probe or reverse engineer models, or conduct automated extraction, scraping, or high-volume querying without our written consent.
7. Your Content and Permissions
“User Content” means information, documents, resumes, job descriptions, prompts, feedback, messages, profile content, and other materials you upload, submit, enter, connect, or generate through the Services.
You retain ownership of your User Content. You grant Workscaler a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, format, adapt, transmit, display, and create technical derivatives of User Content solely as necessary to operate, secure, maintain, support, and improve the Services; provide features you request; enforce these Terms; and comply with law. We do not claim ownership of your resume or career materials.
We will not publicly display, promote, or share your identifiable User Content except as you direct, as necessary to provide the Services, or as described in the Privacy Policy. If we want to use identifiable testimonials, success stories, resumes, or other content for marketing, we will obtain separate permission.
You represent and warrant that you own or have the rights and permissions needed to submit User Content and permit the uses described in these Terms. You are responsible for User Content and the consequences of sharing or submitting it to third parties.
8. Acceptable Use
You may use the Services only in compliance with these Terms and applicable law. You must not:
- Use the Services for fraud, unlawful discrimination, harassment, threats, or other unlawful or harmful conduct.
- Interfere with, disrupt, damage, or bypass the security, integrity, rate limits, access controls, or operation of the Services.
- Introduce malware, harmful code, or material intended to damage systems or data.
- Use bots, scrapers, crawlers, data-mining tools, or automated means to access or collect from the Services without written authorization.
- Copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or create derivative works of the Services except to the extent a restriction is prohibited by law.
- Remove proprietary notices or use Resumás trademarks, logos, domains, or branding in a manner that implies endorsement or affiliation without written permission.
- Use the Services to post, transmit, or make available content that is unlawful, infringing, deceptive, defamatory, obscene, hateful, or invasive of privacy.
We may investigate suspected violations and suspend, restrict, or terminate access where reasonably necessary to protect users, the Services, or others; comply with law; or enforce these Terms.
9. Intellectual Property
Except for User Content, the Services and their software, interfaces, designs, text, graphics, trademarks, logos, databases, compilations, and other materials are owned by Workscaler or its licensors and are protected by applicable intellectual-property laws.
Subject to these Terms, Workscaler grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial career purposes. No other rights are granted by implication, estoppel, or otherwise.
“Resumás,” “MatchScore,” associated marks, logos, and product names are Workscaler trademarks or service marks. You may not use them without our prior written permission, except to refer accurately to the Services.
10. Feedback
If you send us feedback, suggestions, ideas, or improvement proposals, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, distribute, and otherwise exploit that feedback without compensation or obligation to you. Do not send confidential information in feedback unless you are willing for us to use it in this manner.
11. Third-Party Services and Job Listings
The Services may link to or display content from job boards, employers, recruiters, professional networks, app stores, payment processors, integrations, or other third parties. Those third parties control their own content, offerings, decisions, terms, and privacy practices.
Resumás does not endorse or guarantee third-party listings, employers, recruiters, websites, products, services, offers, availability, accuracy, safety, legitimacy, or outcomes. You are responsible for independently evaluating opportunities and third-party services before applying, sharing information, purchasing, or taking other action.
12. Fees, Subscriptions, and Billing
12.1 Pricing and Authorization
Paid Services, pricing, billing intervals, included features, taxes, trial terms, and renewal terms are shown at checkout or in the applicable store listing. By starting a paid subscription or purchase, you authorize the applicable payment provider to charge the disclosed amount and applicable taxes using your selected payment method.
12.2 Automatic Renewal
Unless stated otherwise at checkout, subscriptions renew automatically at the end of each billing period until cancelled. Before you submit payment information, we will present the applicable recurring charge, billing interval, whether the subscription renews automatically, and how to cancel. You must provide affirmative consent to the automatic-renewal terms.
12.3 Cancellation
You may cancel at any time before the next billing date. Cancellation stops future renewal charges but ordinarily does not refund charges already paid, and you generally retain access through the end of the paid billing period unless otherwise required by law or specified at purchase.
| Where purchased | How to cancel |
|---|---|
| Apple App Store | Manage or cancel through your Apple account subscription settings. |
| Google Play | Manage or cancel through Google Play subscription settings or the in-app link to Google Play’s Subscription Center. |
| Resumás website | Cancel through your account settings at [WEBSITE CANCELLATION URL] or contact support@resumas.com. Users who enrolled online must be able to cancel online. |
Account deletion does not automatically cancel a subscription purchased through Apple or Google. You must cancel that subscription through the applicable store.
12.4 Trials and Promotional Offers
If a free trial, introductory price, credit, or promotional offer automatically converts to a paid subscription, the offer terms, duration, recurring price, and cancellation instructions will be disclosed before you enroll. Unless stated otherwise, you must cancel before the trial or promotional period ends to avoid the next recurring charge.
12.5 Refunds
Refunds are handled as required by applicable law and the terms of the payment channel. Apple and Google purchases are subject to their respective refund processes. For website purchases, contact support@resumas.com or use [WEBSITE REFUND REQUEST URL]. Nothing in these Terms limits a non-waivable refund or cancellation right.
12.6 Changes to Fees
We may change fees for a future billing period by providing advance notice as required by law and the applicable store rules. If you do not agree to the new fee, cancel before the next renewal date.
13. Cancellation, Account Deletion, and Termination
You may stop using the Services at any time. You may delete your account in the app through Settings > Account > Delete Account or request account deletion through /delete-account/. See the Privacy Policy for account-deletion effects, verification, data-retention exceptions, and subscription information.
We may suspend or terminate your access, with or without notice where permitted by law, if we reasonably believe you violated these Terms, created a security or legal risk, engaged in fraud or abuse, failed to pay required fees, or if termination is necessary to protect the Services, our users, or third parties.
Sections that by their nature should survive termination, including intellectual-property, payment, disclaimer, liability, indemnity, dispute-resolution, and general provisions, will survive.
14. Privacy and Security
Your use of the Services is subject to the Privacy Policy and, for California residents, the California Privacy Policy. Those policies explain how we access, collect, use, disclose, retain, and delete personal information and how you may exercise privacy choices.
We use safeguards designed to protect the Services and personal information, but no system is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for using reasonable precautions when sharing information online.
15. Copyright Complaints
If you believe content on the Services infringes your copyright, send a written notice that meets the requirements of the Digital Millennium Copyright Act to:
Copyright Agent
Workscaler Inc.
717 K Street
Sacramento, CA 95814
Email: support@resumas.com
Your notice should include: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of good-faith belief that the use is not authorized; a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act; and your physical or electronic signature.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WORKSCALER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.
WITHOUT LIMITING THE FOREGOING, WORKSCALER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS; THAT DATA WILL NOT BE LOST; THAT AI OUTPUTS OR THIRD-PARTY CONTENT WILL BE ACCURATE OR SUITABLE; OR THAT THE SERVICES WILL PRODUCE ANY EMPLOYMENT, INTERVIEW, OR CAREER RESULT.
Some jurisdictions do not permit certain warranty disclaimers. In those jurisdictions, the disclaimers apply only to the extent permitted by law.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKSCALER AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKSCALER’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID WORKSCALER FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) US$100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so these provisions apply only to the extent permitted by law.
18. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Workscaler and its affiliates, licensors, service providers, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your User Content, your misuse of the Services, your violation of these Terms or applicable law, or your infringement of another person’s rights.
19. Disputes, Governing Law, and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
[CHOOSE ONE DISPUTE PATH WITH COUNSEL BEFORE PUBLICATION.]
Option A — Court venue: Except where prohibited by law, disputes arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Sacramento County, California, and you and Workscaler consent to personal jurisdiction and venue there.
Option B — Arbitration: Replace this paragraph with a complete, counsel-reviewed arbitration agreement that includes the arbitration administrator and rules, delegation clause if desired, class-action waiver if legally supportable, small-claims carveout, injunctive-relief carveout if desired, fee allocation, opt-out procedure and deadline, and required consumer notices.
Nothing prevents either party from seeking temporary or preliminary injunctive relief where appropriate to protect intellectual property, confidential information, security, or prevent imminent harm.
20. Changes to the Services or Terms
We may modify, suspend, discontinue, or add features to the Services. We may also update these Terms to reflect changes in the Services, technology, law, or business practices. We will update the “Last Updated” date and provide additional notice for material changes when required.
To the extent permitted by law, continued use after an updated version becomes effective constitutes acceptance. If you do not agree to revised Terms, stop using the Services and cancel any subscription before its next renewal date.
21. General Provisions
These Terms, the Privacy Policy, and any plan-specific, purchase-specific, or written agreement that expressly incorporates these Terms form the entire agreement between you and Workscaler regarding the Services. If a conflict exists, the more specific agreement controls for the subject it addresses.
You may not assign or transfer these Terms without our written consent. Workscaler may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets. If any provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A waiver must be in writing and does not waive later rights. You and Workscaler are independent parties; these Terms do not create a partnership, employment, agency, fiduciary, or joint-venture relationship.
